Community Guidelines & Acceptable Use Policy

These Community Guidelines and Acceptable Use Policy ("Guidelines") govern how you may use the Tabu platform operated by Tabu Co., Ltd. ("Tabu," "we," "us" or "our"), including Tabu’s social and discovery features known as The Scene, profiles, posts, stories, comments, reactions, messages, tagging and mentions, friend and follower connections, Venue and Event content, and other interactive or community features made available from time to time.

These Guidelines should be read together with the Tabu Customer Terms of Service ("Terms"), Privacy Policy and other policies or terms that apply to your use of the Platform. Capitalised terms not defined here have the meanings given in the Terms.

The Acceptable Use provisions in these Guidelines apply to your use of the entire Tabu Platform. The Community Standards additionally apply whenever you create, share, send, upload, display or interact with user-generated content or use Tabu’s Social Features.

Before using the Social Features, you may be required to acknowledge or accept these Guidelines.

1. Our Approach

1.1 Purpose

Tabu is a social discovery and booking platform designed to help people discover places, Events and experiences, connect with other users, share plans and content, and make Bookings.

These Guidelines exist to help keep Tabu:

  1. safe;
  2. respectful;
  3. lawful;
  4. trustworthy; and
  5. useful and enjoyable for users, Venues and Hosts.

1.2 How we apply these Guidelines

Tabu applies these Guidelines having regard to the nature, context, severity and impact of the relevant content or conduct.

A breach does not always result in the same action. Depending on the circumstances, Tabu may:

  1. take no action;
  2. provide guidance or a warning;
  3. remove or restrict particular content;
  4. restrict a feature;
  5. temporarily suspend particular functionality;
  6. temporarily suspend an account;
  7. permanently terminate an account; or
  8. take another proportionate action described in these Guidelines or the Terms.

Serious conduct may justify immediate action without a prior warning.

1.3 Automated and human moderation

Tabu may use a combination of:

  1. automated filtering, detection or moderation tools; and
  2. review by the Tabu Support Team or other authorised personnel,

to identify, prioritise and address potential violations.

Automated systems may flag, filter, restrict or refer potentially problematic content or activity for review. Where appropriate, material enforcement decisions may be reviewed by a person.

Tabu does not guarantee that automated or human moderation will identify every violation.

2. Who These Guidelines Apply To

2.1 Customer users

These Guidelines apply to individuals using Tabu, including users who:

  1. maintain a profile;
  2. follow or connect with other users;
  3. create posts or stories;
  4. upload photos;
  5. comment or react;
  6. send messages and private communications;
  7. tag or mention other users;
  8. share Bookings, Venues, Events or plans;
  9. use The Scene or other Social Features; or
  10. otherwise access or use the Platform.

2.2 Venue and Host accounts

Where Tabu permits an authorised Venue, Host or their representative to maintain an official profile, publish content or interact through Social Features, these Guidelines also apply to that activity, together with the applicable Venue Partner Agreement, Host agreement or other business terms.

Authorised Venue and Host accounts may promote their own Venues, Events and services through functionality made available by Tabu, subject to these Guidelines and any commercial or advertising rules imposed by Tabu.

2.3 Eligibility

You must comply with the eligibility and age requirements set out in the Terms and with any age, identification or admission requirements applicable to particular Venues, Events or Bookings.

You must not:

  1. impersonate another person;
  2. falsely claim to represent a Venue, Host, company or organisation;
  3. create a misleading identity;
  4. misrepresent your affiliation with Tabu; or
  5. help another person circumvent applicable eligibility or age requirements.

2.4 Responsibility for your account

You are responsible for activity carried out through your account, subject to the Terms.

You must take reasonable steps to protect access to your account and notify Tabu if you reasonably believe your account has been compromised.

3. Community Standards

You must not create, upload, post, share, send, display, promote or otherwise engage in content or conduct falling within the categories below.

3.1 Illegal activity

You must not use Tabu to:

  1. commit, encourage, organise or facilitate unlawful activity;
  2. offer, obtain or facilitate illegal goods or services;
  3. facilitate the unlawful sale or provision of regulated goods or services;
  4. evade or encourage another person to evade applicable laws, restrictions or lawful requirements; or
  5. knowingly assist another person in doing any of the above.

Discussion of a topic is not automatically prohibited merely because the topic concerns unlawful conduct. Tabu may consider whether the content actually promotes, facilitates or meaningfully assists prohibited activity.

3.2 Harassment, bullying and stalking

You must not:

  1. bully, threaten, intimidate or harass another person;
  2. repeatedly contact another user after they have clearly indicated that contact is unwanted;
  3. use messages and private communications, tags, mentions, comments or reactions to target or intimidate someone;
  4. organise or encourage coordinated harassment;
  5. stalk another person;
  6. use Tabu to track another person in a way that infringes their privacy or creates a reasonable safety concern; or
  7. encourage others to engage in such conduct.

This includes doing so through location, map, nearby-user or co-presence features.

3.3 Hate and discrimination

You must not attack, threaten, demean or promote hatred against a person or group based on characteristics protected by applicable law or comparable protected characteristics, including race, ethnicity, nationality, religion, sex, gender, sexual orientation or disability.

This does not prevent good-faith discussion of social, political or cultural issues, provided the discussion does not breach these Guidelines.

3.4 Violence and dangerous conduct

You must not:

  1. make credible threats of violence;
  2. encourage violence against another person;
  3. glorify serious real-world violence in a manner that promotes harm;
  4. organise violent activity through Tabu; or
  5. encourage dangerous conduct likely to cause serious harm.

Tabu may restrict graphic or disturbing material even where it does not otherwise violate these Guidelines.

3.5 Sexually explicit and exploitative content

Tabu is not an adult-content platform.

You must not post, send or distribute:

  1. sexually explicit content;
  2. sexual exploitation;
  3. non-consensual intimate images or recordings;
  4. intimate material shared without the subject’s permission;
  5. content seeking sexual services where prohibited by law;
  6. content designed primarily for sexual gratification; or
  7. other sexually exploitative material.

3.6 Child safety

Content or conduct that sexually exploits, sexualises, grooms, endangers or abuses a person under 18 is strictly prohibited.

This includes attempts to:

  1. solicit exploitative material involving a minor;
  2. groom or sexually solicit a minor;
  3. distribute or seek child sexual abuse material;
  4. facilitate sexual exploitation of a minor;
  5. threaten a minor with sexual exploitation; or
  6. encourage another person to engage in such conduct.

Tabu may immediately remove content, preserve relevant records, suspend or terminate accounts and report suspected child exploitation or other serious child-safety matters to appropriate authorities where required or permitted by law.

3.7 Privacy and personal information

You must not:

  1. publish another person’s private or confidential information without authority;
  2. disclose home addresses, identification numbers, private contact details or other sensitive personal information to intimidate or harm someone;
  3. share private messages without a legitimate basis in circumstances that amount to harassment, exploitation or another violation;
  4. publish photographs or recordings in circumstances that unlawfully violate another person’s privacy;
  5. solicit personal information through deception; or
  6. use personal information obtained through Tabu for an unauthorised purpose.

This includes "doxxing" or encouraging others to locate or target another person using private information.

3.8 Fraud, scams and deception

You must not:

  1. commit or attempt fraud;
  2. operate scams;
  3. impersonate another person, Venue, Host or Tabu representative;
  4. engage in phishing;
  5. use false or misleading payment information;
  6. manipulate another user into transferring money or information;
  7. misrepresent tickets, Bookings or access rights;
  8. create fake Venue or Event offers;
  9. use Tabu to facilitate pyramid or comparable deceptive schemes; or
  10. knowingly provide false information for the purpose of obtaining an improper benefit.

3.9 Intellectual property

You must only upload, post or share content that you have the right to use.

You must not knowingly infringe another person’s:

  1. copyright;
  2. trademark;
  3. image or publicity rights;
  4. database rights; or
  5. other intellectual-property rights.

Tabu may remove or restrict allegedly infringing content in accordance with applicable law and Tabu’s intellectual-property complaint process.

4. Spam, Commercial Activity and Promotion

4.1 Normal sharing is allowed

Tabu encourages genuine social discovery.

Users may ordinarily:

  1. share a Venue or Event;
  2. post about plans;
  3. tell friends where they intend to go;
  4. tag or mention Venues, Hosts or other users;
  5. share a Booking through functionality provided by Tabu; and
  6. discuss or recommend places and Events.

This is not prohibited merely because it may increase interest in a Venue or Event.

4.2 Spam and unauthorised commercial solicitation

You must not:

  1. send repetitive or unsolicited promotional messages;
  2. mass-message users for a commercial purpose;
  3. use automated accounts to promote goods or services;
  4. operate an unauthorised commercial advertising account;
  5. solicit users in a deceptive or intrusive manner;
  6. use Tabu principally to divert users to unrelated commercial services; or
  7. repeatedly publish promotional material in a manner Tabu reasonably considers spam.

4.3 Paid or sponsored content

If Tabu permits paid, sponsored or commercially incentivised content, you must comply with:

  1. applicable law;
  2. Tabu’s disclosure requirements;
  3. any applicable advertising rules; and
  4. any requirement to clearly disclose the commercial relationship.

You must not falsely present paid promotion as independent or organic user activity.

4.4 Venue and Host promotion

Verified or authorised Venue and Host accounts may promote their Venues, Events and related offerings through approved Tabu functionality.

They must not:

  1. impersonate a customer;
  2. create fake customer engagement;
  3. manipulate engagement metrics;
  4. make materially misleading claims;
  5. spam users; or
  6. circumvent Tabu’s applicable commercial arrangements.

5. Bookings, Tickets and Platform Abuse

5.1 Fake or abusive Bookings

You must not:

  1. intentionally create fake Bookings;
  2. use Bookings to harass or disrupt a Venue;
  3. create multiple accounts to evade Booking restrictions;
  4. intentionally manipulate availability;
  5. interfere with another user’s Booking; or
  6. systematically make Bookings you do not genuinely intend to use for the purpose of disrupting the Platform or a Venue.

No-Show and Late Cancellation consequences are governed by the Refund & Cancellation Policy and Terms.

5.2 Tickets and transfers

You must not:

  1. counterfeit tickets;
  2. duplicate or unlawfully reproduce a ticket;
  3. sell or transfer a Booking or ticket contrary to the applicable Booking or Event terms;
  4. use a transferred ticket after it has been validly transferred to another user; or
  5. exploit Tabu’s transfer functionality for fraud or unauthorised commercial resale.

A transfer made through Tabu’s authorised transfer functionality is not prohibited where the applicable Booking or Event terms permit it.

5.3 Age and admission rules

You must not intentionally:

  1. misrepresent your age or identity;
  2. use another person’s identification;
  3. assist another user to circumvent disclosed age requirements;
  4. falsify eligibility information; or
  5. exploit the Platform to bypass a Venue or Event’s lawful admission conditions.

5.4 Manipulation of Platform features

You must not improperly manipulate or attempt to manipulate:

  1. engagement;
  2. followers or connections;
  3. likes or Reactions;
  4. comments;
  5. recommendations;
  6. referral programmes;
  7. Points or rewards;
  8. waitlists;
  9. Booking availability;
  10. promotional systems;
  11. rankings; or
  12. other Platform functionality.

This includes coordinated fake engagement, automated engagement and creating accounts primarily to manipulate Platform metrics.

6. Platform Security and Technical Misuse

You must not:

  1. use bots, scripts or automated tools to access the Platform except where expressly authorised by Tabu;
  2. scrape, crawl, harvest or systematically extract Platform data without permission;
  3. attempt to bypass access controls;
  4. probe or test vulnerabilities without authorisation;
  5. interfere with Platform infrastructure;
  6. upload malicious code;
  7. attempt to obtain another user’s credentials;
  8. circumvent rate limits, restrictions or security controls;
  9. reverse engineer parts of the Platform except to the extent a restriction is prohibited by applicable law;
  10. use Tabu systems to launch an attack against another system; or
  11. intentionally impair the performance or availability of the Platform.

Good-faith security reports should be submitted through the contact method designated by Tabu rather than exploited.

7. Posts, Stories, Comments and Reactions

7.1 Posts and stories

Posts, stories, captions, photographs and other content must comply with these Guidelines regardless of whether they are:

  1. public;
  2. visible only to friends or followers;
  3. temporary;
  4. shared with selected users; or
  5. sent through another Tabu sharing function.

Content being temporary or available to a limited audience does not exempt it from these Guidelines.

7.2 Comments

Comments must not be used to:

  1. harass;
  2. threaten;
  3. spam;
  4. impersonate;
  5. disclose private information;
  6. coordinate abuse; or
  7. otherwise breach these Guidelines.

7.3 Reactions

Reactions are lightweight emoji or similar responses to another user’s post, story or shared content.

They are not Venue ratings or public reviews.

Reactions do not have to represent a user’s experience of a Venue because they may simply express a response to another user’s content.

You must not use Reactions:

  1. as part of coordinated harassment;
  2. to repeatedly target or intimidate a user;
  3. through automated or fake accounts;
  4. to manipulate Platform engagement; or
  5. in another manner that violates these Guidelines.

7.4 No public Venue reviews

Unless and until Tabu expressly introduces a public review feature, comments, posts and Reactions must not be represented as an official Tabu Venue rating or verified Tabu review.

Tabu may introduce separate review standards if a review feature is made available in the future.

8. Messages and Private Communications, Tags and Mentions

8.1 Messages and Private Communications

The fact that a message is private does not exempt it from these Guidelines.

You must not use messages and private communications to:

  1. harass or threaten;
  2. send sexually explicit or exploitative material;
  3. scam or defraud;
  4. send spam;
  5. solicit private information through deception;
  6. impersonate;
  7. distribute illegal content; or
  8. repeatedly contact a user who has clearly indicated that the contact is unwanted.

These Guidelines apply to messages, message-log communications and any other private or user-to-user communications made available through Tabu.

8.2 Tags and mentions

You must not use tagging or mentions to:

  1. coordinate harassment;
  2. misrepresent another person’s involvement in content;
  3. falsely associate someone with illegal or harmful activity;
  4. spam another user; or
  5. evade a block or other user-safety control.

8.3 Attempts to evade blocks

You must not:

  1. create another account to contact someone who has blocked you;
  2. ask another user to relay unwanted messages for you;
  3. use Venue or business accounts to evade a personal block; or
  4. otherwise circumvent a user’s block.

9. Blocking and Personal Safety

9.1 Blocking users

Tabu provides functionality allowing users to block other users.

Blocking may restrict or remove the blocked user’s ability to:

  1. contact you;
  2. view or interact with applicable Social Features associated with your account;
  3. appear in relevant search or connection surfaces;
  4. view content where the Platform applies block-based visibility restrictions; or
  5. interact with you through other functions covered by the block.

The exact technical effect of a block may depend on the feature and may evolve as the Platform develops.

9.2 Block does not guarantee real-world separation

Blocking another user prevents or restricts Platform interaction according to Tabu’s functionality but cannot guarantee that the person will not:

  1. encounter you offline;
  2. see information available outside Tabu;
  3. obtain information from another person; or
  4. contact you through a service not operated by Tabu.

9.3 Personal meetings

Tabu facilitates social discovery but does not supervise users who meet offline.

Users should exercise appropriate judgment when interacting with people they know only through the Platform.

9.4 Location and Nearby-User Safety

You must not misuse Tabu’s location, nearby-user, map or co-presence functionality to stalk, harass, intimidate, monitor or target another person.

You must not attempt to circumvent another user’s Ghost Mode, block, location-sharing choice, co-presence setting or other privacy or safety control.

You must also not use information obtained through these features to facilitate conduct that would otherwise violate these Guidelines, including unwanted contact, threats, harassment or disclosure of another person’s location or movements.

10. Your Content and Responsibility

10.1 Responsibility for content

You are responsible for content you create, upload, send or share through your account.

You must have the rights, permissions and authority reasonably necessary to submit that content.

10.2 Rights granted under the Terms

Any licence granted to Tabu in relation to User Content is governed by the Terms.

Nothing in these Guidelines expands Tabu’s rights to use your personal data beyond what is permitted under the Privacy Policy and applicable law.

10.3 Other people’s content

User Content represents the views or activity of the relevant user and does not necessarily represent Tabu.

Tabu does not endorse User Content merely because it appears on the Platform.

To the fullest extent permitted by law, you should exercise your own judgment before relying on information provided by another user.

11. Moderation

11.1 Moderation methods

Tabu may moderate content and activity through:

  1. automated filters;
  2. automated risk or safety signals;
  3. user reports;
  4. Tabu Support Team review;
  5. information supplied by Venues or Hosts;
  6. payment, fraud or security signals where relevant;
  7. legal notices; or
  8. another lawful source of information.

11.2 Possible moderation actions

Tabu may:

  1. prevent content from being uploaded;
  2. reduce or restrict visibility;
  3. hide content;
  4. remove content;
  5. disable access to content;
  6. restrict commenting, posting or messaging;
  7. temporarily lock a feature;
  8. ask a user to modify or remove content;
  9. issue a warning;
  10. refer the matter for further human review; or
  11. take enforcement action under Section 14.

Tabu will not ordinarily rewrite the substance of a user’s content on the user’s behalf. Tabu may make technical formatting changes or redact limited material where reasonably necessary for privacy, safety, legal compliance or platform operation.

11.3 Prioritisation

Tabu may prioritise reports and moderation based on factors such as:

  1. immediate safety risk;
  2. child-safety concerns;
  3. credible threats;
  4. potential illegality;
  5. fraud or financial harm;
  6. privacy harm;
  7. severity;
  8. number of affected users; and
  9. whether harmful content is continuing to spread.

The fact that Tabu has not yet acted does not mean that the content complies with these Guidelines or prevent Tabu from acting later.

12. Reporting Users and Content

12.1 Community Reports

If you believe a user, post, story, comment, message, profile, image or other content violates these Guidelines, you may use Tabu’s in-app reporting functionality.

Reports may include a category such as:

  1. spam;
  2. harassment;
  3. impersonation;
  4. inappropriate content;
  5. fraud or scam;
  6. privacy concern;
  7. safety concern; or
  8. another violation.

12.2 Reporting in good faith

You should make reports honestly and in good faith.

A report does not need to result in enforcement for the report to have been legitimate.

However, knowingly submitting false reports, coordinating malicious reports or repeatedly abusing the reporting process to harass another user may itself violate these Guidelines.

12.3 Reporter confidentiality

Tabu does not ordinarily disclose the identity of a person who submits an ordinary Community Report to the reported user.

Tabu may disclose information where:

  1. required by law;
  2. required to investigate the matter fairly;
  3. necessary to respond to a serious safety issue; or
  4. otherwise permitted by the Privacy Policy and applicable law.

12.4 What happens after a report

The Tabu Support Team may:

  1. review the reported material;
  2. review relevant surrounding context;
  3. examine relevant account history;
  4. request additional information;
  5. use automated systems to assist review;
  6. take interim protective action;
  7. take enforcement action;
  8. determine that no violation occurred; or
  9. refer the matter for legal, security or specialised review.

13. Legal, Illegal-Content and Intellectual-Property Notices

13.1 Separate legal-notice process

An ordinary in-app Community Report is intended for potential violations of these Guidelines.

Where a person wishes to submit a formal legal notice alleging unlawful content or requesting legal removal action, the notice should be submitted through Tabu’s designated legal-content channel:

Tabu may publish a more detailed notice-and-takedown procedure or legal reporting form.

13.2 Information Tabu may require

For a formal legal notice, Tabu may require sufficient information to:

  1. identify the person submitting the notice;
  2. identify the specific content, account or material complained of;
  3. locate the material on the Platform;
  4. understand the legal basis of the complaint;
  5. contact the person submitting the notice;
  6. assess whether the notice is genuine; and
  7. comply with applicable legal procedures.

Tabu may reject or request additional information for a notice that is materially incomplete.

13.3 Notice to affected user

Where appropriate and permitted by law, Tabu may inform the affected user:

  1. that content has been reported or restricted;
  2. the general basis for the action;
  3. what content is affected; and
  4. whether the user may contest the action.

Tabu may withhold information where disclosure is prohibited by law or would create a material safety, security or investigation risk.

13.4 Copyright and intellectual-property complaints

Formal copyright or intellectual-property complaints should be sent to:

Tabu may require:

  1. identification of the protected work or right;
  2. identification of the allegedly infringing material;
  3. information sufficient to locate it;
  4. the complainant’s contact details;
  5. confirmation of the complainant’s authority; and
  6. any declaration or other information required by applicable law.

Where applicable, Tabu may provide the affected user with a process to respond to or contest an infringement notice.

13.5 Repeat infringement

Repeated or serious infringement of third-party intellectual-property rights may result in content restrictions, account restrictions, suspension or termination.

14. Enforcement

14.1 General enforcement approach

There is no universal fixed "strike" threshold for Community Guidelines violations.

One violation may justify serious action where the circumstances are sufficiently serious. In other cases, Tabu may provide one or more warnings or take less restrictive measures before suspending an account.

Tabu may consider:

  1. seriousness of the violation;
  2. actual or potential harm;
  3. whether the conduct was intentional;
  4. frequency;
  5. whether the conduct is repeated;
  6. previous warnings or enforcement;
  7. attempts to evade prior enforcement;
  8. the user’s explanation;
  9. the reliability of available evidence;
  10. immediate safety or legal risk; and
  11. whether a less restrictive measure is likely to be effective.

14.2 Available actions

Tabu may take one or more of the following actions:

  1. take no further action;
  2. issue guidance;
  3. issue a warning;
  4. remove or restrict content;
  5. restrict posting;
  6. restrict comments or Reactions;
  7. restrict messages and private communications;
  8. restrict tagging or mentions;
  9. restrict The Scene or other Social Features;
  10. restrict certain Booking functionality where reasonably connected to the violation;
  11. temporarily suspend relevant features;
  12. temporarily suspend the account;
  13. permanently terminate the account;
  14. invalidate fraudulent or abusive Platform activity;
  15. preserve relevant records;
  16. report relevant conduct where permitted or required by law; or
  17. pursue other legal or contractual remedies.

14.3 Serious Violations

Conduct that may justify immediate restriction, suspension or termination includes, depending on the circumstances:

  1. child sexual exploitation or serious child endangerment;
  2. credible threats of serious violence;
  3. serious harassment or stalking creating a substantial safety risk;
  4. serious fraud or scams;
  5. serious impersonation used to deceive or harm others;
  6. deliberate distribution of serious unlawful content;
  7. significant security attacks or attempts to compromise Tabu systems or user accounts;
  8. serious sexual exploitation or non-consensual intimate material;
  9. serious unlawful activity conducted through the Platform;
  10. deliberate evasion of a previous serious enforcement measure; or
  11. repeated serious violations after prior enforcement.

This list is illustrative and does not prevent Tabu from acting on comparably serious conduct.

14.4 Warnings are not always required

Tabu may act immediately where:

  1. a Serious Violation occurs;
  2. urgent action is reasonably required for safety or security;
  3. there is credible fraud;
  4. required by law or a competent authority;
  5. necessary to prevent ongoing serious harm; or
  6. a user is deliberately evading an existing enforcement measure.

15. Effect on Bookings and Payments

15.1 Social enforcement does not automatically cancel Bookings

A Community Guidelines violation does not automatically cancel an existing confirmed Booking or ticket.

Where misconduct relates only to Social Features, Tabu will ordinarily consider restrictions directed at those Social Features rather than unrelated existing Bookings.

15.2 When Booking functionality may be affected

Tabu may restrict new Bookings or take action concerning an existing Booking where reasonably necessary because of:

  1. Booking fraud;
  2. payment abuse;
  3. ticket fraud;
  4. a credible safety risk;
  5. conduct materially connected with the relevant Venue, Host or Event;
  6. eligibility or admission issues;
  7. serious misuse of the Booking system;
  8. a legal or regulatory requirement; or
  9. another serious violation materially connected to the Booking.

15.3 Refunds

Any refund, payment correction or non-refund resulting from cancellation or enforcement is determined under:

  1. the Refund & Cancellation Policy;
  2. the Booking-specific terms;
  3. the Event-specific terms; and
  4. applicable law.

Enforcement under these Guidelines does not by itself create a separate rule that all payments are forfeited.

16. Suspension and Account Restrictions

16.1 Duration

Where Tabu imposes a temporary restriction or suspension, the duration may vary depending on the circumstances.

There is no fixed suspension period applicable to every violation.

Tabu may consider the factors in Section 14.1 when setting or reviewing the duration.

16.2 Notice

Where Tabu materially restricts or suspends an account, Tabu will ordinarily provide:

  1. notice of the action;
  2. the general reason;
  3. whether the action is temporary or permanent;
  4. the expected duration, where applicable; and
  5. information on how to request review.

Tabu may limit or delay information where disclosure:

  1. is prohibited by law;
  2. could materially compromise fraud prevention;
  3. could compromise security;
  4. could expose another person to a material safety risk; or
  5. could prejudice a lawful investigation.

16.3 Existing access during restriction

Where reasonably possible and appropriate, a restriction on Social Features or new Booking functionality will not prevent the user from accessing information reasonably necessary to:

  1. view an existing Booking;
  2. use an existing valid ticket;
  3. receive an eligible refund;
  4. contact Tabu Support;
  5. exercise applicable privacy rights; or
  6. request review of enforcement.

This does not apply where restricting that access is itself reasonably necessary for safety, fraud, legal or security reasons.

17. Appeals and Review

17.1 Requesting review

A user subject to material content removal, feature restriction, suspension or termination may request review through:

Appeals / Enforcement Review: support@tabubookings.com, or the in-app support route at Settings → Help → Support

The request should identify:

  1. the affected account or content;
  2. the relevant enforcement notice, where available;
  3. why the user believes the decision was incorrect; and
  4. any relevant information or evidence.

17.2 Review process

The Tabu Support Team may review:

  1. the original decision;
  2. relevant content;
  3. available context;
  4. previous account history;
  5. user submissions;
  6. reports or evidence; and
  7. automated signals that contributed to the decision.

Where reasonably practicable, a material appeal should not be decided solely on the basis of the same automated signal that triggered the original enforcement without appropriate review.

17.3 Possible outcomes

Following review, Tabu may:

  1. uphold the original decision;
  2. reduce the restriction;
  3. shorten a suspension;
  4. restore content;
  5. restore functionality;
  6. reverse the action entirely; or
  7. impose a different proportionate measure.

17.4 Abuse of appeals

Good-faith appeals are permitted even where Tabu ultimately upholds the original decision.

Knowingly fraudulent or abusive use of an appeal process may itself be considered under these Guidelines.

18. Off-Platform Conduct

Tabu may take proportionate action in response to conduct occurring outside the Platform only where there is a sufficiently strong connection to Tabu and the conduct creates a material concern relating to:

  1. user safety;
  2. serious harassment or stalking arising from a Tabu interaction;
  3. fraud involving a Tabu Booking, ticket, Venue, Host or user;
  4. serious threats involving Tabu users;
  5. serious misconduct at a Venue or Event connected with a Tabu Booking;
  6. attempts to circumvent Platform enforcement; or
  7. Platform security or integrity.

Tabu does not claim authority over users’ private lives generally.

The purpose of this section is to allow Tabu to address serious conduct materially connected with the safety or integrity of the Tabu community.

19. Information Sharing and External Reports

19.1 When Tabu may share relevant information

Tabu may disclose relevant information to a Venue, Host, payment provider, service provider, professional adviser, competent authority or another appropriate party where reasonably necessary and permitted by law to:

  1. investigate fraud;
  2. address a safety issue;
  3. resolve a relevant Booking or payment issue;
  4. respond to an unlawful-content notice;
  5. investigate a security incident;
  6. protect another user;
  7. respond to legal process; or
  8. comply with applicable law.

19.2 Proportionate disclosure

Tabu will seek to limit such disclosure to information reasonably relevant to the applicable purpose, subject to the Privacy Policy and applicable law.

A Community Guidelines violation unrelated to a Venue, Booking or payment matter will not ordinarily be disclosed to a Venue or payment provider merely because that party has another relationship with Tabu.

20. Changes to These Guidelines

20.1 Updates

Tabu may update these Guidelines to reflect changes in:

  1. Platform functionality;
  2. Social Features;
  3. safety or moderation practices;
  4. applicable laws or regulatory requirements;
  5. emerging forms of abuse; or
  6. Tabu’s policies.

20.2 Material changes

Where required by the Terms or applicable law, Tabu will provide notice before a material change takes effect.

Where required, the notice may explain:

  1. the principal change;
  2. the date it takes effect;
  3. any action the user must take; and
  4. any applicable right to stop using or terminate the relevant service.

20.3 Existing enforcement

Changes to these Guidelines will not ordinarily be used to treat conduct as a violation retroactively where the conduct complied with the Guidelines applicable when it occurred, except where action is required by law or necessary to address continuing safety, security or unlawful activity.
